The breach occurred due to an isolated email error on April 16, when a Merrill Lynch employee, the plan’s record keeper and part of Bank of America's investment and wealth management division, inadvertently sent the information to an unauthorized recipient. Merrill Lynch became aware of the incident on April 22.

The exposed data includes:

  • Names
  • Social Security numbers

Merrill Lynch has assured affected customers that the errant email was deleted and stated that there is no evidence of misuse of the disclosed personal information.
